We invite you to read our General Terms and Conditions of Sale ("GTCS") before using our website, www.the-sundaycollective.com, (the "Site") and/or making a purchase. Please note that any online purchase implies full acceptance of these Terms and Conditions.
The T&Cs apply between you, as a consumer and non-professional, and us, Manon Lopez, individual entrepreneur whose head office is located at 21 rue d'aguesseau 92100 Boulogne Billancourt, registered as an individual entrepreneurs (simplified micro-fiscal regime). Please note that these GTC are likely to evolve because we reserve the possibility of modifying them at any time according to the evolutions of the Site and/or the regulation. We would like to specify that the terms and conditions in force at the time of placing your order will be applicable to you.

1. HOW TO ORDER ON OUR SITE?
You can order your favorite items directly on our Site.
The offers of products and prices are valid as long as they are visible on the Site, within the limits of available stocks. In case of commercial operations, the duration of the offer will be indicated on the Site and in our newsletters. It may happen that our products are temporarily unavailable, and you will be informed of this on the product sheet. We invite you to enter your email address in order to be alerted as soon as your favorite item is back in stock thanks to our "Unavailability Alert".
To order, it is very simple:

  • Select your items, the size you want and add them to your cart. At any time you can check the number of items in your cart and get detailed information about each of them by clicking on "Cart". After adding the first item to your cart, you can continue shopping by closing the cart pop-up;

  • Once your cart is finalized, click on "Checkout";

  • Choose the delivery method you want and fill in your delivery address;

  • Choose your payment method (see below the article "How to pay your order" for more information on payment methods), read and accept the entirety of the GTC and proceed to the secure payment of your order. The payment of your order implies full acceptance of these GTC;

  • Your order is validated! You will receive an email confirming your order.

By placing an order, you declare to be at least 18 years old and to have the legal capacity (or if you are a minor, to have a parental authorization to place your order).
If you wish to cancel or modify your order right after confirmation, you must send us an email at shop.thesundaycollective@gmail.com (note that this must be done before the shipping email is sent). 
Once your order has been prepared by us, you will receive an email informing you that your items have been shipped. You will then be able to follow the status of your order from the tracking information contained in the email. If you do not receive an email (neither confirmation nor shipment of your order), you can contact us for more information.
There may be times when we have to cancel your order for a legitimate reason, for example:

  • when you have been able to place an order but your product is unavailable: we will inform you as soon as possible and refund the amount of your article as soon as possible;

  • when a technical error occurs during your payment;

  • when an obvious error has crept into the product sheet (for example when there is an error on the essential characteristics of the product, or when an obviously erroneous price is displayed);

  • when we notice a fraudulent or abusive use of your account or the orders attached to it;

  • when we reasonably believe that you have violated our Terms and Conditions.

2. THE DESIGN AND PRICES OF OUR PRODUCTS
The designs of our products are unique and created by Manon Lopez, founder and manager of The Sunday Collective. 
The prices of our products are indicated on the Site in euros, all taxes included (TTC), excluding shipping costs (which will be specified when you choose your delivery method). They take into account the Value Added Tax (VAT) and possible reductions applicable to our commercial operations in force on the day of your order.
No request for a VAT refund will be accepted in the case of a purchase made online.
 
3. HOW TO PAY YOUR ORDER ?
The payment of your order is made directly online by credit card (CB, Visa, MasterCard, American Express) or by Paypal. 
After confirmation of your payment by our payment provider, your bank account or your Paypal account will be debited with the total amount of your order.
We would like to reassure you that all your transactions are secure and comply with the legal provisions in force: they take place within a strict framework of confidentiality and encryption of all your data at our payment provider.
We do not have access at any time to your personal data concerning your means of payment, in particular your credit card, and we do not store them on our servers.
Your order will not be considered final until payment is made. 
 
4. DELIVERY OF YOUR ORDER
4.1 Where and how can you be delivered?
Your orders can be delivered in Europe, according to the following delivery methods:

  • Standard home delivery: have your order delivered directly to the address of your choice;

  • Delivery in a relay point: select the relay point closest to your home.

You will be able to follow the progress of your order, as soon as you receive the email confirming the shipment of your order with the tracking information.
In case of absence during the delivery of your order, for home deliveries, a notice of passage will be given to you to give you the modalities of recovery of your order.
 
The price of the delivery is determined according to the final address of delivery, this price is displayed in your basket when you provide your shipping information and the selected mode of delivery. For an international delivery, please contact us on the contact form or by email (shop.thesundaycollective@gmail.com) in order to receive a quote for the delivery costs. 
 
4.2 When will you be delivered ?
When you place your order, the delivery time of your items will be specified. Please note that it may be extended during busy periods (e.g. during sales). Please also note that we have slow production cycles, you may have to wait up to 14 days for your order to be shipped. (To learn more about our slow cycle click here).

5. WHAT ARE OUR TERMS OF RETURN, REFUND AND EXCHANGE?
In order to facilitate the return of your products, we grant you a maximum total period of 14 days from the day you received your order to return your products under the conditions described in articles 5.1. and 5.2.
 
5.1 The products that you wish to return must be new, unworn, undirty and returned in their original packaging, or failing that, in packaging that guarantees equivalent protection
Your return by post is done in two steps:

First of all, you have a 15-day period from the date you received your order. During this period, you can exercise your right of withdrawal by writing to us via email with the following information:

  1. order number

  2. item(s) you wish to return,

  3. reason for the return

  4. your name

  5. postal address

  6. email address

  7. telephone number.

We will get back to you with a return label. Please note that the return shipping costs will be at your expense. 

-Once the return label is issued, you then have a period of 7 days from the issue of your return label to return your package by mail. 
 

5.2 When will you be refunded?
Once your return has been verified by our services, you will receive an email confirming your refund.
We commit ourselves to reimburse you the amount corresponding to the returned product(s), as soon as possible and at the latest within 30 days following the date of reception of your return in our warehouse, or of the provision of a proof of shipment of your return.
Your refund will be made directly to the account linked to the credit card or to the paypal account used for the payment of the order. You will receive an email confirming the refund once it has been validated by our systems. 
Any return of a product which is not new, and which would be worn and/or soiled and/or damaged and/or whose label is missing will be returned to you and will not give rise to a refund.
 
6. WHAT GUARANTEES FOR YOUR PRODUCTS ?
Our products benefit from legal guarantees, i.e. the legal guarantee of conformity and the guarantee of hidden defects. As a seller, we are effectively responsible for
1. of the defects of conformity of the products that you buy, under the conditions of article L.217-4 and following of the Consumer Code. The legal guarantee of conformity applies when your product presents a defect of conformity, for example when your product does not function in accordance with the uses to which this product is usually put, or when it does not correspond to the description given;
2. and its hidden defects under the conditions of Article 1641 and following of the Civil Code. The warranty for hidden defects covers you when your product has a hidden defect, i.e. a defect that is not apparent at the time of sale and that makes the product unfit for its intended use or that greatly diminishes this use.
Please note that the legal guarantee of conformity and the guarantee of hidden defects will not be applicable in case of misuse of your products or failure to comply with the maintenance conditions provided on our labels or by our alterers.
If you act in legal guarantee of conformity, you :
- have a period of two (2) years from the delivery of the product to act;
- can choose between repair or replacement of the product, subject to the cost conditions provided for in Article L.217-9 of the Consumer Code;
- are exempted from proving the existence of the lack of conformity of the goods during the twenty-four (24) months following the delivery of the goods.
The legal guarantee of conformity applies independently of any commercial guarantee that may have been granted.
You can decide to implement the guarantee of hidden defects in the sense of article 1641 of the civil code. In this case, you can choose between the termination of the sale or a reduction of the sale price in accordance with Article 1644 of the Civil Code.
 
7. YOUR PERSONAL DATA
We treat your Personal Data with the utmost care and confidentiality.

8. RESPONSIBILITY AND FORCE MAJEURE
We commit ourselves to describe with the greatest accuracy the products we sell on the Site and to ensure in the best possible conditions the update of the information which are diffused there.
We cannot be held responsible in the event of a breach of one of our contractual obligations resulting from a case of force majeure as defined by the regulations. In particular, we will not be held responsible for any non-performance or delay in the execution of your orders, caused by events beyond our control, such as

  • Strikes, closures or other industrial actions;

  • Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not), or threat or preparation for war;

  • Fire, explosion, storm, flood, earthquake, subsidence, epidemic and pandemic or other natural disaster;

  • Inability to use rail, water, air, road or other private or public transportation;

  • Inability to use public and private telecommunications networks;

  • Acts, decrees, legislation, regulations or restrictions of any government (e.g. administrative closure of stores);

  • Failure or accidents of maritime, postal or other transport.

The execution of the GTC will be suspended as long as the case of force majeure lasts and the execution and delivery deadlines will be extended accordingly. However, we shall do our utmost to put an end to the case of force majeure or to find a solution enabling us to perform our contractual obligations despite the case of force majeure.
 
9. WHAT IF WE DISAGREE?
Please note that our GTC are subject to French law, and that your orders are subject to the GTC in force on the day of your order.
